By submitting a registration and/or by participating in an event, or any facet of the event (“Event”), you (“Participant”) hereby agree to and acknowledge the following Terms and Conditions (“Agreement”) as an irrevocable condition of your participation in the Event:

1.        Participant's registration to take part in the Event, and any such registration and/or participation in the Event further demonstrates Participant’s acknowledgement of this Agreement and shall also automatically bind Participant to this Agreement.  Furthermore, regardless of any advanced registration or any failure of Participant to register in advance, any participation in the Event shall automatically bind Participant to this Agreement.   

2.        Whenever applicable, Participant should donate to the charitable benefactor and/or pay any entry fee to participate, or have sponsored the Event in some way.

3.        In consideration of being permitted to participate, observe, enter, and/or any other facet of the Event, Participant hereby acknowledges and agreed that this Agreement shall apply to himself, herself, personal representatives, heirs, family members, business associates, and next of kin.  Furthermore, Participant acknowledges by participating in Event, that any and all associated parties shall also be bound by this Agreement.

4.        By registering, attending, participating and/or taking part in the Event, and as consideration for being allowed to participate in the Event, Participant acknowledges receipt of, and agrees to all of the terms, conditions, agreements, releases, acknowledgements and other terms of the Agreement.

5.        Participant hereby agrees that the organizers, people, businesses and entities involved in planning, hosting, supporting and organizing the Event, including but not limited to organizers, managers, sponsors, venues, employees, Police Departments, Sheriff's Offices, Florida Highway Patrol (all collectively referred to as “Organizer”) and other participants, are not responsible, nor liable, in any way whatsoever to Participant for whatever reason, for any actions or inactions, related to the Event.  In addition, Participant hereby releases and agrees to hold harmless Organizer and other participants from any liability whatsoever from any claims, damages or injuries arising from or related to the Event.  Furthermore, Participant hereby assumes and accepts full responsibility and liability, and further agrees to hold Organizer and other participants harmless, and releases same from any liabilities whatsoever, and shall indemnify and defend same from any claims, damages or injuries, regardless of whether or not Organizer or other participants were negligent in any way whatsoever.  In addition, Participant hereby agrees that Organizer and other participants are not responsible for conditions created or caused by the negligent or wrongful act or omission of the Organizer, other participants, or any other person, place or thing.  Furthermore, Participant agrees that Organizer and/or other participants are not responsible for, nor liable for Participant’s personal injury, personal property, or belongings.

6.        If Participant, at any time, feels anything related to the Event to be unsafe, Participant shall immediately advise the Organizer of such, and shall immediately cease participation in the Event.

7.        “Participant” shall also include, but not be limited to, the Participant, his/her personal representatives, assigns, heirs, family members, business associates, and next of kin.

8.        Participant hereby releases, waives, discharges, and covenants not to sue the Organizers, all for the purposes herein as releases from all liability to the Organizer for any and all loss or damage, and any claim or demands therefore on account of injury to the person or property or resulting in death of the undersigned arising out of or related to the Event, weather caused by the negligence of the Organizer or otherwise.

9.        Participant hereby agrees to indemnify and save and hold harmless the Organizer and each of them from any loss, liability, damage or cost they may incur arising out of or related to the undersigned’s injury of death, weather caused by the negligence of the Organizer or otherwise. This Agreement shall extend to all acts of negligence of Organizer.  Furthermore, Participant hereby agrees to indemnify and defend Organizer for any acts of Participant that cause any loss, liability, damage or cost that Participant causes.

10.      Participant hereby assumes full responsibility for any risk of bodily injury, death , or property damage arising out of or related to the Event, whether caused by the negligence of Organizer, Participant, or otherwise. 

11.      Participant hereby acknowledges and agrees that all of the terms, conditions, releases, and irrevocable conditions of participating in the Event, including but not limited to the terms and conditions of this Agreement, shall apply to all passengers, guests, minors, children, additional participants or any other persons that Participant may bring to the Event or who participates in this Event in any way whatsoever.

12.      On the morning of the Event, Participant must obtain from Organizer, at check-in, a wristband, or other identification required or determined necessary by the Organizer, in order to be identified as a Participant.  Anyone who does not obtain said identification may be denied access to the Event.

13.      The wristband, or other identification method as determined solely by Organizer, will allow the Organizer, Security, and/or law enforcement, if any, to identify who is, and who is not part of the Event.  Participant(s) may be denied access to the event at any time, at Organizer's sole discretion.

14.      All cars/Participants must drive in a legal manner, following all rules, laws, and safety precautions at all times, to help ensure the safety of all Participants and the public.  Any failure of Participant to do so shall automatically eliminate Participant from the Event and any connection to the Event whatsoever.  Notwithstanding the foregoing, any automatic or any other elimination of Participant from the Event shall not invalidate this Agreement, and this Agreement shall continue in full force and effect.

15.      There may be Police Officers, Sherriff Deputies, Florida Highway Patrol Officers, and/or other law enforcement agencies escorting the Event.  Participant must obey all instructions of law enforcement and the Organizer, and must follow all applicable laws at all times.

16.      The Event is NOT a race, nor a high-speed venue.  Speeding, aggressive driving, reckless driving, unsafe driving, and/or any other driving/moving violations will NOT be tolerated.  In addition, driving under the influence of any substance, including but not limited to alcohol or drugs, will NOT be tolerated.  Participant must drive safely at all times, including, but not limited to: Participant shall not speed, and must follow all laws!!!  If Participant falls behind the group of other participants while driving, Participant shall not speed or drive recklessly to catch up, Participant shall not tailgate other cars, Participant shall look both ways before crossing any intersections, seatbelts must be worn at all times by Participant while in vehicle.  The previous examples are just that; examples, and in no way whatsoever represent all of the safe driving mandates required of Participant.  Participant shall consider safety and following all applicable laws as paramount and primary.  Participant shall follow all applicable laws and rules of the road at all times.  Any violation of any laws or terms of this Agreement may result in law enforcement actions, termination of Participant from Event, or both, in addition to any other actions Organizer deems appropriate. 

17.      Participant must have his/her or her own valid insurance, license and registration.

18.      Participant’s car must be in roadworthy condition.

19.      Other than Organizer approved materials relating to the Event, Participant or any other persons may not display, distribute or utilize any promotional materials, or advertise or solicit for business in any format, on their vehicles or via any other method, for the entirety of the Event, unless prior approval is granted by Organizer.

20.      Participant hereby agrees that any photography, video or electronic capture or recording of the event is the property of Organizer and may be utilized by Organizer in any manner Organizer deems appropriate, including but not limited to, promotional advertising, website pictures, future productions or promotions, and Participant hereby consents to, authorizes, releases, and waives any rights to and any compensation for Organizer’s use of any such material.

21.      Organizer, at Organizer’s sole and exclusive option, reserves the right to refuse access to, participation in, or continued participation in the Event, for any reason whatsoever, including but not limited to failure of Participant to properly register, abide by any laws, rules or agreements, the necessity of Organizer to properly manage the number of participants, Organizer’s priority or desirability of automobiles to be utilized in the Event, or for any other reason Organizer deems appropriate.

22.      Participant hereby acknowledges all of the terms and conditions of this Agreement prior to signing this Agreement and the start of the Event and his/her participation in the Event constitutes his/her binding agreement to the terms and conditions hereof.

23.      Organizer reserves the right to modify or change the terms and conditions or this Agreement at any time prior to the Event.  Please make sure you are familiar with the terms and conditions of the Agreement prior to the start of the Event, as your participation in the Event constitutes your binding agreement to the terms and conditions thereof.Participant hereby acknowledges all of the terms and conditions of this Agreement prior to signing this Agreement and the start of the Event and his/her participation in the Event constitutes his/her binding agreement to the terms and conditions thereof.

24.      The Agreement is intended to extend to all acts of negligence of Organizer, and is intended to be as broad and inclusive as is permitted by the laws of the State or province in which the Event is conducted, and that if any portion thereof is held invalid, it is agreed that the balance of the Agreement shall, notwithstanding, continue in full legal force and effect.

By registering and/or participating in the Event, Participant acknowledges he/she has read this Agreement, its terms and conditions, understands all facets of the Agreement, including but not limited to Participant's binding and irrevocable release and waiver of liability, assumption of risk, and indemnity provisions.  Furthermore, Participant acknowledges that he/she understands the terms of the Agreement, and understands that he/she has given up substantial rights by registering and/or participating in Event, and has chosen to register and/or participate in Event freely and voluntarily without any inducement, assurance, or guarantee being made.  Participant's registration and/or participation in the Event shall be further evidence of Participant's complete and unconditional release of all liability to the greatest extent allowed by law.
